Hosting Terms
WebStop Australia Pty Ltd provides a variety of hosting services, including web hosting (both Windows and Linux based), mail hosting, database services and URL forwarding. Since these services use resources that are shared by many users, the benefits of using the service must be balanced with certain obligations and responsibilities to ensure that all users can have a productive experience.
By using these services, you agree to be bound by the terms and conditions; you agree to indemnify and hold harmless WebStop Australia Pty Ltd from any loss, liability, claim, damage and expense arising from or related to your content or use of any services provided by WebStop Australia Pty Ltd. If you are not satisfied with these terms and conditions then you must discontinue use of our hosting services.
WebStop Australia Pty Ltd may revise these terms and conditions from time to time by posting a new version of this document on our terms and conditions page.
Any new version of these terms will be effective within 14 days of posting unless WebStop Australia Pty Ltd considers (in its sole discretion) that a period shorter than 14 days is necessary to protect the integrity, security or smooth operation of WebStop Australia Pty Ltd services. As such, users should consult this document on a regular basis to ensure that they are familiar with the most recent version.
You accept legal responsibility for use of the account, are at least 18 years of age or (if younger) have your parent’s or legal guardian’s permission before using our services.
The hosting services must not be used for unlawful purposes. Any use of these services which violates any local, state, federal or international laws applicable to WebStop Australia Pty Ltd, your jurisdiction, or any jurisdiction that your site is subject to is strictly prohibited.
You agree that use of our services is at your own risk. The services are provided by WebStop Australia Pty Ltd on an “AS IS” and “AS AVAILABLE” basis. WebStop Australia Pty Ltd expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
No advice or information, whether oral or written, obtained by you from WebStop Australia Pty Ltd, its employees or associates or through their respective websites shall create any warranty not expressly stated in these terms and conditions.
WebStop Australia Pty Ltd does not tolerate SPAM. If you use spam, unsolicited emails or message board posting, or any other similar method to promote your site, then your access to our services will be immediately terminated.
WebStop Australia Pty Ltd reserves the right to take action, including legal or suspension of or termination of a service, against a customer who interferes with the rights of another user online, or attempts to interfere with the smooth running of the internet or WebStop Australia Pty Ltd services. We reserve the right to discontinue, without refund or notice, any account or service where usage of the account or service is deemed to be an abuse, and we will charge the customer for costs incurred by any such abuse.
You are responsible for any misuse of our services, even for example, if the misuse was committed by a friend, family member, guest, employee or customer with access to your account or website. You are also responsible for any such misuse regardless of whether it was with or without your consent. Therefore, you must take steps to ensure that others do not gain unauthorised access to your account or website.
WebStop Australia Pty Ltd reserves the right to refuse or discontinue service to anyone at our sole discretion without notice. Your access to all or part of our services may be denied without notice if WebStop Australia Pty Ltd believes any of the terms and conditions have been violated.
You understand that you must maintain your own copy/backup of any content published via a WebStop Australia Pty Ltd hosting service and that WebStop Australia Pty Ltd should never be used as any “master” or primary or critical copy of any content whether it be Website or email data/files.
You understand that no intellectual property rights are assigned to you in the use of a service provided by WebStop Australia Pty Ltd unless otherwise specifically contracted.
Likewise none of your intellectual property rights are assigned to WebStop Australia Pty Ltd via the use of a service provided by WebStop Australia Pty Ltd unless otherwise specifically contracted.

Payment & Renewals
To ensure your hosting account does not expire, you should renew immediately when you receive your invoice.
Failure to renew your hosting account by the expiration date may result in a loss of your online identity making it difficult for your customers and friends to locate you on the web.
Any invoice that is outstanding for 14 days and not paid will result in a $35 late fee and/or an account suspension until account balance has been paid in full. The $35 late fee is applied in addition to whatever else is owed to WebStop Australia Pty Ltd for services rendered. Access to the account will not be restored until payment has been received.
WebStop Australia Pty Ltd to be Held Harmless
Customer agrees that it will protect, indemnify, save and hold WebStop Australia Pty Ltd, harmless from any and all stipulations, liabilities, losses, expenses, loss of website or email data and claims, as well as reasonable legal fees assessed against WebStop Australia Pty Ltd, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it’s customers, agents, employees or assigns. Customer agrees to defend, indemnify and hold WebStop Australia Pty Ltd, harmless against liabilities arising out of;
- 1. any injury to person or property caused by any products sold or distributed in association with WebStop Australia Pty Ltd Services;
- 2. any material furnished by customer infringing or allegedly infringing on the proprietary rights of a third party;
- 3. copyright violation and any defective products sold to a customer from WebStop Australia Pty Ltd Services.
Email Hosting Package
Email Hosting Packages are not for website Hosting, only for Email Hosting. Failure to use this Hosting Package correctly will result in your Email Hosting Package being suspended until upgrade is purchased.
Disclaimer
WebStop Australia Pty Ltd will not be responsible for any damages your business may suffer. WebStop Australia Pty Ltd makes no warranties of any kind, expressed or implied for services we provide. WebStop Australia Pty Ltd disclaims any warranty or merchantability or fitness for a particular purpose. This includes web and email data loss resulting from delays, non-deliveries, wrong delivery, non payment of account and any and all service interruptions of any kind caused by WebStop Australia Pty Ltd and its employees or product suppliers such as Domain Names and reseller Hosting. WebStop Australia Pty Ltd reserves the right to amend or update these policies without notice. Failure to follow any terms and conditions may result in account deactivation.
